Terms of Service

1 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Rostan Technologies ("Company", "we", "us") governing your access to and use of the SmartTrack GPS platform, including:

• The web dashboard at gps.rstglobal.in
• The SmartTrack GPS mobile application (Android)
• All APIs, microservices, and backend infrastructure
• GPS hardware integration protocols (GT06, JT808, Teltonika, NMEA, MQTT, HTTP)

By creating an account, downloading the mobile app, or connecting any device, you confirm you are at least 18 years old and have the legal authority to enter into this agreement.

2 Description of Service

SmartTrack GPS is a fleet management and vehicle tracking platform that provides:

• Real-time GPS tracking via hardware trackers and mobile app
• Trip history, route playback, and distance analytics
• Geofence creation and breach alerts
• Driver behaviour monitoring (speeding, hard braking, accident detection)
• Multi-protocol GPS device support (GT06, JT808, Teltonika, NMEA, MQTT)
• Multi-stakeholder portals for OEM manufacturers, dealers, and finance partners
• Push, SMS, and email alert notifications

We reserve the right to modify, suspend, or discontinue any feature of the service with reasonable notice.

3 Account Registration

To use SmartTrack GPS, you must create an account with accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of unauthorized access at support@rstglobal.in
• Ensuring all users added to your account accept these Terms

One account may manage multiple devices, vehicles, and users depending on your subscription plan. Account sharing with unauthorized parties is prohibited.

4 Acceptable Use

You agree not to use SmartTrack GPS to:

• Track individuals without their informed consent
• Violate any applicable law, regulation, or third-party rights
• Attempt to reverse-engineer, decompile, or hack the platform
• Overload, disrupt, or interfere with platform infrastructure
• Introduce malware, viruses, or malicious code
• Scrape or mass-download data using automated tools
• Resell or sublicense access to the platform without written permission
• Use the service for any illegal surveillance or stalking

Violations may result in immediate account termination and may be reported to law enforcement.

5 GPS Tracking Consent

You are solely responsible for ensuring that all persons and vehicles tracked using SmartTrack GPS have provided the necessary legal consent and notification as required under applicable law, including but not limited to:

• Informing employees that company vehicles are tracked
• Obtaining written consent where required by local employment law
• Complying with India's Personal Data Protection regulations
• Posting visible notices in tracked vehicles where legally required

Rostan Technologies is not liable for any misuse of the tracking platform by account holders. The responsibility for lawful tracking lies entirely with the account owner.

6 Subscription Plans & Payments

• Subscriptions are billed monthly or annually in advance
• Payments are non-refundable except as required by law
• Failure to pay may result in service suspension after 7 days notice
• Prices are subject to change with 30 days advance notice
• GST applicable as per Indian tax law

To cancel your subscription, go to Dashboard → Payments → Cancel Subscription or contact billing@rstglobal.in.

7 Intellectual Property

All content, software, logos, designs, and technology comprising the SmartTrack GPS platform are owned by Rostan Technologies or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the platform solely for your business's fleet management purposes. You may not copy, modify, distribute, or create derivative works from any part of the platform without written permission.

The SmartTrack GPS mobile app is licensed to you, not sold. Your licence is tied to your active subscription.

8 Data Ownership

Your data is yours. All GPS location data, trip records, device information, and account data you generate remain your property. We process it solely to provide the service.

You may export your data at any time via the Reports section of the dashboard. Upon account deletion, your data will be removed within 30 days except where retention is required by law.

By using SmartTrack GPS, you grant us a limited licence to store, process, and display your data for the purpose of providing the service to you.

9 Service Availability

We target 99.5% monthly uptime for core tracking and alert services. Planned maintenance windows will be announced at least 24 hours in advance via email and in-app notification.

The service is provided "as is" and "as available". We do not warrant uninterrupted or error-free operation.

10 Limitation of Liability

To the maximum extent permitted by applicable law:

• Rostan Technologies shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim
• We are not liable for losses arising from GPS signal failure, tracking inaccuracy, or service unavailability
• We are not liable for any actions taken based on tracking data (e.g., disciplinary action against employees)

Some jurisdictions do not allow limitation of liability for certain damages, so the above may not apply to you in full.

11 Termination

You may terminate your account at any time by contacting support. Access will continue until the end of the current billing period.

We may terminate or suspend your account immediately without notice if you:

• Violate these Terms, especially the Acceptable Use policy
• Engage in illegal surveillance or tracking without consent
• Fail to pay subscription fees after notice period
• Provide false registration information

Upon termination, your access to the platform ceases immediately. Data export requests must be made before termination.

12 Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or use of SmartTrack GPS shall be subject to the exclusive jurisdiction of the courts in India.

We encourage resolving disputes informally first — contact us at legal@rstglobal.in. If informal resolution fails, disputes may be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996 (India).
